By using this platform, you agree to adhere to the following:

1. Fair Use of Digital Materials

   • All tracks which are made available through this platform are the sole property of Creator. As such, prior to their release, you are permitted to use them solely as follows:

     1. Inclusion in a live performance routine.

     2. Inclusion in a live radio broadcast mix.

     3. Inclusion in a mix uploaded to streaming platform(s) with express written consent of Creator.

        1. If a track list is to be provided, you must credit the track as "Stupid Fried - ID"

   • Under no circumstances are you permitted to:

     1. Claim the work as your own, including, but not limited to the following:

        1. Distributing the track across streaming platforms.

        2. Listing the work as original as part of a mix track list.

        3. Telling others by word of mouth when sharing in an informal setting.

        4. As part of a live performance routine.

     2. Share the work in any scenario not explicitly described by this document.

2. Consequence of Non-Compliance

   1. Failure to comply with the terms defined by this document may result in the following:

      1. Revoked Access - You may be removed from this platform without warning.

      2. Forfeit of Fees - Any earned revenues from falsely claimed work, may be reclaimed by Creator, variable under the following conditions:

         1. Performance use of work without permission

            1. You must pay Creator an equivalent percentage of your booking fee based on duration of performance

            2. Additional damages owed to Creator, the amount of which is subject to change based on Artist booking fee, plus any additional arbitrary amount as determined by Creator

         2. Distribution of work

            1. You must pay Creator the greater value between all royalties earned to date or $100.

            2. Additional damages owed to Creator, the amount of which is subject to change based on Artist booking fee, plus any additional arbitrary amount as determined by Creator

      3. Public Defamation - Your name will be exposed as a fraudulent actor in public discourse in any, or all, of the following:

         1. On social media platforms in the direct and extended network of Creator.

         2. By word of mouth to industry professionals in the direct and extended network of Creator.

3. Clarification of Fair Use

   1. If any language used in the above is unclear to you, please contact evan@stupidfried.com for consideration of your use case.

      1. No response is not equivalent of acknowledged fair use. You must have a use case which clearly falls into the above-permitted scenarios, or explicit communication from Creator regarding your use case.
